SESSION TERMS & CONDITIONS By checking the boxes, I agree to all the policies outlined below.

1. COPYRIGHT. All photographs taken by Charleen Claire Photography are copyright protected. It is a violation of federal copyright law to alter or reproduce work created by Charleen Claire Photography. This includes but not limited to cropping, applying additional editing past the photographer’s digression, copying for digital or print, or using in advertisement without permission of Charleen Claire Photography. Charleen Claire Photography reserves all rights to all negatives, raw files, and finished images. Charleen Claire Photography will offer limited print release to paid customers. Sharing images online and/or on social media is allowed when credit to Charleen Claire Photography is properly given. When sharing images, images must be presented as originally delivered to the client; this means no additional editing or “filters” may be used on the image. The images that are being provided to you are licensed to you for any reason personal, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Photographer may revoke this license at any time and for any reason. Photographer retains all copyrights to the images and derivative works thereof.

2. Creative License *

CREATIVE LICENSE. Images taken by Charleen Claire Photography are edited at their discretion. Delivered proofs may not include all captured photographs. Charleen Claire Photography reserves the right to edit and release only those images deemed creditable as professional in quality and within the Charleen Claire Photography’s artistic standard. Client(s) may request editing but Charleen Claire Photography holds the right to decline if it takes away from our style or brand. Additional editing may require additional fee.

3. Investment *

INVESTMENT. Session prices established by Charleen Claire Photography are final. A deposit is required to book all sessions. Deposits are non-refundable. The remaining balance for the session is required at the start of the session. For sessions that take place over multiple dates and times, the total investment is required at the first of the sessions. Print investments ordered through Charleen Claire Photography are required to be paid at the time the order is placed. Accepted payments include cash, check, or credit.

4. Expenses *

EXPENSES. Charleen Claire Photography has the right to charge for any fees or expenses that may occur during a session. This can include but not limited to admissions into locations, travel accommodations, special requests of client, etc. Mileage expenses are incurred for trips outside of Pensacola.

5. Model Release *

MODEL RELEASE. The Client authorizes Charleen Claire Photography to use and to create images for promotional materials, online usage, and other areas of marketability. The Client further authorizes the distribution of photographs to potential clients of Charleen Claire Photography for portfolio purposes. The Client agrees and understands that the photos will be taken digitally. The Client further acknowledges that the Client will not be compensated, either now or at any time in the future, for any use of marketing and that Charleen Claire Photography of such photos exclusively owns all rights. The Client acknowledges and agrees that Charleen Claire Photography shall have the exclusive, perpetual, and irrevocable right to take, use, re-use, publish, and republish photographic materials which contain the Client’s image. The Client hereby acknowledges and agrees that Charleen Claire Photography may modify, change, or alter such images without restriction. The Client hereby acknowledges and agrees that the photographs created by Charleen Claire Photography shall become and remain the exclusive property of the Photographer, and that the Client retains no rights to said photographs unless specified particularly in this Release. The Client, also hereby waives all rights and claims and releases Charleen Claire Photography from any claim or cause of action, whether now known or unknown, relating to the sale, display, license, use, and exploitation of the photos. The Client hereby covenants and agrees that the Client shall not bring any action or proceeding or maintain a complaint against Charleen Claire Photography in any court of law, state or local, or before any administrative body, related in any way whatsoever, to the use of the photographs. The Client also consents to the use of the Client’s own name or any fictitious name, which may be chosen in connection with the aforesaid photographs. The Client hereby releases any and all claims whatsoever in connection with the use of the Client’s photographs and name and the reproduction thereof as aforesaid. The Client hereby waives any right that the Client may have to inspect and/or approve the photographs or any advertising copy that may be used in connection therewith or the use to which it may be applied.

6. Minor Release *

MINOR RELEASE. In the event that a client is under the age of eighteen, a parent or guardian is required to sign the contract and model release along with them. All minors are also required to be accompanied by a parent or guardian during the session. I am the parent or legal guardian of the minor named above and have the legal authority to execute the above release. I agree that this Release is irrevocable, perpetual and worldwide. I approve the foregoing and waive any rights in the premises. I have read this Release and am fully familiar with its contents.

7. Special Photo Requests *

SPECIAL PHOTO REQUESTS. Charleen Claire Photography is willing to entertain any special requests of images that you have however, Charleen Claire Photography is not responsible if an image is unobtainable due the unwillingness of the session participants (including pets), unfavorable weather conditions, the unavailability of desired locations, etc.

8. Locations and Permissions *

LOCATIONS & PERMISSIONS. It is the client’s responsibility to schedule and receive permission to use their desired locations for their session that is not owned by the client. Some public properties may have photographic restrictions and it is the client’s responsibility to find that out and report results to Charleen Claire Photography. Charleen Claire Photography will not be held accountable if any violations occur in relation to this.

9. Image Proofing *

IMAGE PROOFING. All sessions will be delivered to the client by an online viewing gallery. A gallery ID and password will be provided to the client once the session is ready for viewing. The online viewing gallery will expire in one week and clients may download their full resolution portraits as many times as they would like to as many devices as they would like. If a client would like a DVD or a USB, one can be provided for an extra fee.

10. Printing Services *

PRINTING SERVICES. Charleen Claire Photography has tested several professional printing labs and has chosen a select few labs to trust with clients’ orders. All images are printed on archival paper with the best quality inks. Once the session is ready for viewing, the client will receive printing information sent to their email. Print ordering is available directly through Charleen Claire Photography and through your online gallery. Your order can be shipped directly to you.

11. Turnaround Times *

TURNAROUND TIMES. Delivery of all products included or ordered will be delivered to the client in timely matter. Charleen Claire Photography will provide images as they get completed, with your entire gallery being complete within three weeks of your session. All print orders are expected for delivery 3-15 business days.

12. Cancelation and Reschedule *

CANCELATION & RESCHEDULING. In the event that you need to reschedule due to sickness, injury, or other unforeseen events, please contact Charleen Claire Photography as soon as possible and your session will be rescheduled at the next available time. Respectfully, Charleen Claire Photography also reserves the right to reschedule a session due to sickness, injury, or other unforeseen events beyond one’s control. In this event, Charleen Claire Photography will notify client(s) immediately and reschedule at the next earliest availability. In the event that you cancel and do not reschedule your session, your deposit is non-refundable and non-transferable. In case of inclement weather, either party has the right to reschedule based on their own digression.

13. Tardiness *

TARDINESS. The session time outlined in your contract indicates the time the session is to start. If for some reason you are running late, please contact Charleen Claire Photography as soon as possible so they are aware. Client(s) tardiness is taken out of their session time. If client(s) do not contact Charleen Claire Photography by fifteen minutes after the session was indicated to start, Charleen Claire Photography has the right to cancel the session and the client(s) will forgo their deposit. In the event that Charleen Claire Photography is running late, Charleen Claire Photography must contact the client(s) as soon as possible. Tardiness by Charleen Claire Photography will not cut into the client(s) scheduled session time. If the delay is a hindrance to the client(s), compensation will be offered.

14. Returned Checks *

RETURNED CHECKS. Returned checks are subject to a $50 returned check fee. Client(s) will be responsible for any and all collection costs and legal fees incurred by Charleen Claire Photography.

15. Technological Failure *

TECHNOLOGICAL FAILURE. In the event of camera malfunction, memory card obstruction, or a hard drive crash resulting in lost images, Charleen Claire Photography will provide compensations for the inconvenience by providing another session or full refund.

16. Archavial Recovery *

ARCHAVIAL RECOVERY. In the event that a client needs their images recovered from Charleen Claire Photography’s archive, there will be a fee of $50. Sessions are moved to the archive after one year.

17. All Sales are Final *
